General Practitioners prevail in court procedure against Government of the Netherlands Antilles
On September 2, 2008 the Court of Appeal of the Netherlands Antilles and Aruba rendered a judgment in a case which was instituted by the associations of general practitioners from Curacao, Bonaire and the Windward Islands against the Government of the Netherlands Antilles. The doctors made objections against the reduction of the per annum fees that they receive for the medical treatment of each SVB insured patient.
The Court of Appeal has declared the national ordinance of August 31, 2001 to be nonbinding as to the annual fee of the doctors of ANG 123,66 per patient. At the same time the judgment was rendered that the per annum fee for all doctors that are associated with the SVB as of September 1, 2001 is ANG 133,38. The Government was instructed to amend the ordinance in such a way that as of September 1, 2001 the per patient per annum fee of ANG 133,38 will apply retroactively.
